Pai, aproxima de mim esse cálice : significações de juízes e promotores sobre a função paterna no contexto da justiça

Abstract

Este estudo tem como principal objetivo verificar a significação que os juízes e promotores atribuem aos seus papéis. Para tal verificou-se o nível de consciência da função paterna no exercício jurisdicional, a partir do conceito de “Pai Jurídico”, de forma a contribuir para a efetiva estruturação de decisões voltadas à construção da subjetividade individual e do espaço coletivo do cidadão. Para tanto utilizou-se autores da psicanálise, da psicossociologia, da psicologia jurídica, além de juristas que fazem a interseção entre o direito de família e a psicanálise. A proposta metodológica desse trabalho se baseia nos pressupostos da pesquisa qualitativa, enfocando a análise da entrevista clínica reflexiva, tendo sido desenvolvida em dois momentos: um questionário aberto e um texto que serviu de base para a entrevista realizada com os sujeitos da pesquisa. Os resultados apontam que os operadores da justiça percebem que no exercício de sua função jurisdicional exercem a função paterna – “Pai Jurídico” - junto ao adolescente em conflito com a lei e suas famílias, e que sentem necessidade de um maior aporte social e político através da implementação de políticas públicas necessárias para que o ECA possa ser efetivamente implantado. _______________________________________________________________________________ ABSTRACT

This study aimed at investigating the main significance that judges and prosecutors attribute to their roles. Therefore, the level of conscience of the father's role in the jurisdictional practice based on the concept of “Juridical Father” was investigated, in order to contribute to the effective structuring of decisions towards the construction of the individual subjectivity and of a citizen's collective space. Thus, Psychoanalysis, Psychosociology and Juridical Psychology authors have been researched and quoted, in addition to jurists, who provide the intersession between family Law and Psychoanalysis. The methodology used was based on qualitative research presuppositions, focused on the reflexive clinical analysis interview, which was developed in two distinguishing moments: an open questionnaire and a text served as basis for the accomplishment of the interviews held with the participants in the study. The results point out that justice representatives realize that while exercising their jurisdictional role, hold a paternal role as well – “The Juridical Father” - when together with the adolescent in conflict with the respective family and the Law, and these representatives also feel the need of a greater social and political support, through the implementation of public policies necessary in order to have ECA effectively implemented.
