Transformações nas Nações Unidas : da reforma na ONU à criação do Conselho de Direitos Humanos

Abstract

O final do século XX apresentou fatos importantes que auxiliam a compreensão de um processo ainda inacabado: o reordenamento do Sistema Internacional. Neste contexto, o tema da reforma das Nações Unidas surge com grande força. Assim sendo, esta dissertação tem por objetivo estudar a resposta da ONU frente aos desafios que este momento evidencia, com foco especial sobre sua estrutura no campo dos direitos humanos. Para tanto, busca encontrar os parâmetros que guiaram este movimento de reforma refletidos nos trabalhos de Boutros Boutros-Ghali e Kofi Annan, ex-Secretários-Gerais das Nações Unidas entre 1992 e 2006. Ainda avalia com especificidade a estrutura dos direitos humanos e a transição da Comissão de Direitos Humanos das Nações Unidas para o Conselho de Direitos Humanos das Nações Unidas. Finalmente, argumenta sobre a possibilidade de se perceber significativos avanços tanto institucionais, quanto procedimentais, mesmo em ambiente que o comportamento egoísta dos Estados - na busca pela realização de seus próprios interesses - possa comprometer a eficiência do órgão. _________________________________________________________________________________ ABSTRACT

The end of the twentieth century had important facts which help to understand a still unfinished process: the reordering of the International System. In this context, the issue of UN reform emerges with great strength. This dissertation aims to study the UN responses to the contemporary challenges with special focus on UN’s human rights structure. To achieve it, this essay tried to find the right parameters that guided the movement of reform reflected through the administrations of Boutros Boutros-Ghali and Kofi Annan, ex-General Secretaries of the United Nations between 1992 and 2006. Also evaluates specifically the UN structure of human rights, and, the transition of the United Nations Commission on Human Rights to Human Rights Council of the United Nations. Eventually, argues about the possibility of perceiving institutional and procedural progress, even the environment in which the selfish behavior of states - in the search for the realization of their own interests - could undermine the efficiency of the body.
